CORAM:HON'BLE MR. JUSTICE AMIT RAWAL -.- AMIT RAWAL J. (ORAL) As per the zimni orders vide Annexure P-5, particularly the orders dated 12.12.2013, 09.06.2014, 22.09.2014 and 29.09.2014, there is no satisfaction recorded with regard to the service of the applicants. The Presiding Officer has only mentioned about the presence of candidates namely Gajja Singh and Gurdeep Singh whereas Malkiat Singh son of Baldev Singh was also a candidate. It is in this aspect of the matter, he challenged the order (Annexure P-2) appointing the petitioner as Chowkidar and the Deputy Commissioner vide order Annexure P-3, noticing the fact that no opportunity had been given to the respondents, set aside the aforementioned order.

In view of the aforementioned zimni orders, I am of the view that the finding rendered by the Deputy Commissioner is perfectly legal and just This Court called upon the counsel for the petitioner to apprise this Court as to what happened after the 23.11.2016. No information has been supplied but orally it has been averred that nothing proceeded further. CWP No.11269 of 2016 -2regarding remand is upheld but with a modification that the SDM shall consider the case of the petitioner and other candidates who had applied for the post of Chowkidar within a fixed time line i.e. as expeditiously as possible and preferably within a period of 4 months from the date of receipt of certified copy of this order.

The writ petition stands disposed of with the above observations.
