The petitioner seeks an order directing the respondents to open the e-tenders and to proceed with the tender process. 2.

The respondents cannot be faulted for not carrying the tender process further at this stage. The petitioner's licence was temporarily withdrawn by an order dated 25.06.2015. This was not a final decision. The licensing authorities are yet to take a final decision in this regard. The petitioner challenged this order by filing CWP No.18312 of 2015 in which an interim order has been passed staying the order dated 25.06.2015. The effect thereof is that the licence is valid at this point of time. However, that petition is yet to be decided. The respondents indeed can, in view of the interim order dated 31.08.2015, proceed with the tender process. However, their decision to await further orders in the writ petition on the issue of cancellation of licence cannot be said to be unreasonable.
