CWP-22489-2010 (O&M) -2Constables have been deputed to Intermediate School Course without opportunity of hearing to the petitioners.

The petitioners were brought on List C-1 in 1999. There were few constables who were brought on List C-II in excess of 10% quota. On the directions of this Court, the Exemptee Head Constables were reverted who were in excess of 10% quota. The petitioners claimed promotion from retrospective date i.e. date on which Exemptee Constables were promoted in excess of 10% quota. Their prayer was allowed and they were promoted from retrospective date. However, respondent again revised seniority list and made them junior to Exemptee Constables.

Learned State counsel states that most of the petitioners have retired on attaining the age of superannuation. 4.
Learned counsel for the petitioner submits that they have no instructions and they may be granted liberty to move an appropriate application within three months, if cause survives. 5.
Dismissed with aforesaid liberty.
