**** RAJ MOHAN SINGH, J. (Oral) Petitioner has preferred this petition for issuance of an appropriate writ, order or direction especially in the nature of mandamus directing respondent No.3 to release the payment of the petitioner including earnest money as well as security for the work of construction completed by the petitioner. On 12.11.2021, following order was passed:- "The case has been taken up for hearing through video conferencing.

Learned State counsel has placed on record communication issued to his office in the present writ petition whereby the department

-2has sanctioned an amount of Rs.10,98,952/- on 10.11.2021 towards the claim of the petitioner. Learned State counsel submits that the aforesaid amount shall be paid within 10 days to the petitioner.

Learned counsel for the petitioner seeks short adjournment to have further instructions. Adjourned to 24.11.2021."

Today, learned counsel for the parties submit that an amount of Rs.10,98,952/- has been paid and received by the petitioner- Society towards final bill of the amount due, however, learned counsel for the petitioner submits that the security for the work done and earnest money have not been answered so far.

Learned counsel further submits that in the context of aforesaid two claims, he would represent before the concerned authority and this petition may be disposed of at this stage as such.

Learned State counsel also submits that in case, the petitioner represents his pending claim before respondent No.3, the same shall be dealt with in accordance with law at the earliest.

-3Petitioner would also be at liberty to stake its claim qua the interest before the competent authority for the delayed payment, if any.

Disposed of.
