(ORAL) This writ petition has been filed by the petitioner being aggrieved by the fact that it had been awarded contract for supply of medicines at various centers in the State of Punjab for two years commencing from 31.03.2022. However, without any show cause notice being issued to the petitioner or cancellation of its contract, the respondent-authorities have issued a fresh tender notice dated 11.07.2022 (Annexure P-9) seeking to award the same work and contract that is already existing and subsisting with the petitioner to a successful bidder in that contract.
Learned senior counsel, appearing for the petitioner, submits that the respondent-authorities having not cancelled its contract, it has not even been able to participate in the fresh tender proceedings and in such circumstances, it has filed a representation dated 13/14.07.2022 (Annexure P-10) before them, but they have not taken any cognizance or decision thereon.
Mr. Avinit Avasthi, learned Assistant Advocate General, Punjab, on instructions from respondent No. 3, namely, Managing Director, Punjab Health Systems Corporation, SAS Nagar, Mohali, submits that the respondentauthorities would consider and take a decision on the petitioner's representation 13/14.07.2022 (Annexure P-10) within a day including the prayer made by it regarding postponement of the fresh tender proceedings that have been initiated on 11.07.2022 as well as extension of the last date for submission of a bid by the petitioner and communicate the same to it accordingly. CWP-15324-2022 (O&M) In view of the aforesaid statement made by learned State counsel, we do not find any reason to entertain the present writ petition which is accordingly disposed of. It is made clear that this Court has not expressed any opinion on the merits of the case and, therefore, the authorities would be at liberty to examine the matter keeping all facts and facets into consideration and thereafter accept or reject the same in accordance with law.
