(ORAL) Petitioners are before this Court, inter alia, seeking issuance of a writ in the nature of mandamus directing the official respondent to restrain the construction of an Over head Supply Reservoir ("OHRS") within small premises of the Government Elementary School, village Bal Kohna, Tehsil Nakodar, District Jalandhar providing education to about 50 students of village Bal Kohna Tehsil Nakodar, District Jalandhar. 2.

Learned counsel for the petitioners contends that respondents are constructing OHRS over the land in dispute, which is currently being used for an Elementary School (upto 5th class), an Anganwari Centre and a Sports Clubcum-Gym. It is further pleaded that about 50 students are studying in said School and number of residents are using the sports club/gym. He further contends that construction of over head tank shall cause constant nuisance to the students and further, chances of upgrading the School shall come to an end. Perusal of the record reflects that petitioner has neither filed any representation nor approached any authorities for mitigation of his grievance and has straightway approached this Court. Therefore, no ground for interference by this Court is made out.
