State of Haryana and Others .............Respondent CORAM: HON'BLE MR.JUSTICE JASWANT SINGH Present:- Mr.Vikram Singh,Advocate for the petitioner Jaswant Singh,J.(Oral) Complainant is in writ petition assailing the appellate order dated 8.6.2015(P-8) passed under Section 51(5) of the Haryana Panchayati Raj Act,1994 whereby the order dated 15.4.2015 passed by Deputy Commissioner,Karnal suspending the Sarpanch of Gram Panchayat Nigdu,Tehsil Nilokheri,Distt.Karnal has been set aside and the matter remanded back to the Deputy Commissioner,Karnal for passing a fresh detailed speaking order after duly considering the explanation/evidence put forth by the Sarpanch.

After hearing counsel for the petitioner, I find that no ground for interference is made out since it has come on record that the explanation/evidence put forth by the Sarpanch has not been considered while passing the suspension order. CWP 12449/2015 remanded back to the Deputy Commissioner concerned for passing a fresh detailed speaking order after considering the entire material placed on record by the Sarpanch. No serious prejudice appears to have been caused to the present complainant.

In view of the above,finding no merit in this writ petition the same is hereby dismissed.
