SANDHAWALIA, J.(Oral) Prayer in the present petition filed under Articles 226/227 of the Constitution of India is for quashing of the impugned order dated 15.07.2021 (Annexure P-9), whereby no teacher has been selected for the State Teachers Award-2020 under the category-B (Elementary-Primary School Head Teacher).

Counsel has submitted that he would be satisfied if the representation dated 02.12.2020 (Annexure P-8) of the petitioner is decided in a time bound manner. The petitioner is stated to be eligible under Category-B as Head Teacher as per Annexure P-1 and it is the contention of counsel for the petitioner that as per the said policy, total number of four awards for Primary School Head Teachers was to be granted but none has SACHIN MEHTA 2021.08.25 16:26 I attest to the accuracy and authenticity of this document High Court, Chandigarh

CWP-16353-2021 -2made the grade as per the order dated 15.07.2021. It is submitted that the petitioner had applied and his record was checked but the marks against Comprehensive and Competitive Evaluation (C.C.E.) have not been granted. It is submitted that in case, the petitioner is a beneficiary, there are certain incentives including two years extension in service beyond superannuation i.e. up to 60 years.

Mr. Aman Bahri, Addl. A.G. Haryana accepts notice on behalf of respondents.

Keeping in view the above, this Court does not feel it appropriate to call for reply of the respondents, which will only cause delay in decision making process.

Accordingly, without commenting on the merits of the case and the entitlement of the petitioner, directions are issued to respondent No.2 to decide the representation dated 02.12.2020 (Annexure P-8) within a period of four weeks on receipt of certified copy of this order. In case, the petitioner is not found entitled for the relief claimed or there is any legal impediment, a reasoned order be passed and conveyed to the petitioner. In case, it is found that the petitioner is entitled for the said claim, respondents shall also ensure that all consequential benefits are granted to him irrespective of the fact that he is going to retire on 31.08.2021.
