**** RAMENDRA JAIN, J. (ORAL) Through this revision, petitioner-complainant has laid challenge to judgment dated 25.01.2018 of the appellate court, whereby, his appeal was dismissed in default for want of prosecution. In nutshell, on the complaint of the petitioner, private respondents No.2 to 5 were booked and tried under Sections 323, 325/34 IPC, but only held guilty under Sections 323 and 34 IPC by the trial court, acquitting them under Section 325 IPC and were released on probation vide judgment dated 04.11.2016.
Being aggrieved, the petitioner approached the first appellate court for conviction of the petitioner under Section 325 IPC and releasing them on probation, but his appeal was dismissed in default for want of prosecution vide impugned judgment dated 25.01.2018. Perusal of file shows that private respondents have already faced SONIKA 2019.03.02 00:00 I attest to the accuracy and authenticity of this document Chandigarh protracted trial for around 6 years. They have been held guilty under
CRR No.2284-2018 --2-- Sections 323 and 34 IPC by the trial court.
