(ORAL) Through this revision, petitioner-complainant has laid challenge to judgment dated 25.01.2018 of the appellate court, whereby, his appeal was dismissed in default for want of prosecution. In nutshell, on the complaint of the petitioner, private respondents No.2 to 5 were booked and tried under Sections 323, 325/34 IPC, but only held guilty under Sections 323 and 34 IPC by the trial court, acquitting them under Section 325 IPC and were released on probation vide judgment dated 04.11.2016.

Being aggrieved, the petitioner approached the first appellate court for conviction of the petitioner under Section 325 IPC and releasing them on probation, but his appeal was dismissed in default for want of prosecution vide impugned judgment dated 25.01.2018.
