MANJARI NEHRU KAUL, J. (ORAL) Petitioner is seeking the concession of anticipatory bail under Section 438 of the Cr.P.C. in case FIR No.30 dated 09.02.2024 under Sections 120-B/420 of the Indian Penal Code, 1860, and Section 3(2) of The Haryana Protection of Interest of Depositors in Financial Establishment Act, 2013, registered at Police Station Panipat City. 2.

Vide order dated 11.07.2024. the petitioner had been granted interim anticipatory bail with direction to join investigation and the relevant part of the said order reads as under:- "Learned counsel for the petitioner at the outset has drawn the attention of this Court to Annexure R-2, which is the Certificate of Incorporation of the company, Hindustan Energy Savers Private Limited, and submitted that it clearly stands reflected therein that the petitioner was appointed as a Director of the aforesaid company only on 28.11.2023. Not only this, his original date of appointment was also PUNEET SACHDEVA 2024.09.30 13:57 I attest to the accuracy and integrity of this document Chandigarh

CRM-M-28561-2024 -228.11.2023. It has been thus argued that once the petitioner had nothing to do with the aforesaid company, there could have been no occasion for him to lure or dupe the victims/complainants of crores of rupees on pretext of electric scooty and electricity saver cars."

Learned counsel for the petitioner submits that in compliance of order dated 11.07.2024, the petitioner has joined investigation and cooperated with the investigating agency. 4.

Learned State counsel, on instructions from ASI Rajender Singh, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for his custodial interrogation. 5.

In view of the above, the petition is allowed and interim order dated 11.07.2024, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) BNSS.
