(Oral) This is a petition under Article 226/227 of the Constitution of India praying for issuance of writ in the nature of certiorari to quash the practice adopted by the respondent-University to discontinue/relieve the petitioner during vacations/breaks period and further issuance a writ in the nature of mandamus directing the respondents to grant/release full salary and allowance for the vacation/break period. On asking of the Court, Mr. Hitesh Pandit, Addl.A.G. Haryana accepts notice on behalf of the State. Learned counsel for the petitioner is directed to supply copy of the petition to the learned State counsel by today itself during the course of the day.
It has remained undisputed that the relief sought by the petitioner in the instant writ petition has already been sought by another applicants/petitioners before this Court in CWP No. 9300 of 2015 titled as Mrs. Menka and others vs. State of Haryana and others and connected matters, decided on 05.05.2016. The aforesaid petition was allowed by interpreting Rules and Regulations.
