-.- KARAMJIT SINGH , J. (Oral) Prayer is for grant of anticipatory bail in case having FIR No.180 dated 1.7.2022 registered under Sections 420, 406, 120-B IPC, at Police Station Division No.6, District Ludhiana. Counsel for the petitioner submitted that the petitioner is running a furnace and he used to purchase raw material (sponge iron) from the complainant and now due to some misunderstanding delay occurred in making payment of the said raw material to the complainant by the petitioner. The counsel for the petitioner further submits that the dispute being of civil nature, the petitioner has already filed suit for rendition of PUNEET CHAWLA 2022.09.14 10:34 I attest to the accuracy and authenticity of this order/judgment
( 2 ) CRM-M-30973-2022 accounts against the complainant, which is pending in the Court of Civil Judge at Ludhiana and copy of the plaint is Annexure P-4. The counsel for the petitioner further submits that the petitioner has joined investigation with the police in the light of previous order dated 20.7.2022 passed by the Coordinate Bench of this Court.
State counsel on instructions from ASI Ranbir Singh has not disputed the fact that the petitioner has joined investigation and the fact that civil litigation is already going on between the parties regarding money in dispute. The State counsel further submits that now the petitioner is not required by police for further investigation or for custodial interrogation. In view of the above, without commenting on the merits of the case, present petition is allowed and order dated 20.7.2022 is hereby made absolute. The petitioner should abide by the conditions envisaged under Section 438(2) Cr.P.C.
