Grewal, J.(Oral) The present petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short-'BNSS') for quashing of impugned order dated 23.07.2024 (Annexure P-4) passed by the Court of learned Judicial Magistrate First Class, Bathinda, Punjab vide which the petitioner has been declared as proclaimed person under Section 82 Cr.P.C and without appreciating the facts of the case, FIR No. 150 dated 21.06.2022 under Section 379-B, 411 IPC registered at Police Station Civil Lines Bathinda, District Bathinda, Punjab with a further prayer to stay the operation of impugned order dated 23.07.2024.

Learned counsel for the petitioner submits that the petitioner had been granted the concession of regular bail in the present FIR vide order dated 09.08.2022 passed by learned Addl. Sessions Judge, Bathinda. He further submits that the petitioner was in custody in another FIR and therefore he could not attend the court proceedings.

Mr. Amandeep Singh Samra, AAG, Punjab accepts notice on behalf of the respondent-State. He opposed the prayer made by the learned counsel for the petitioner on the ground that the petitioner got arrested in another FIR during the concession of bail.

I have heard the learned counsel for the parties and perused the record.

The petitioner during his bail did not keep good conduct and has involved himself in another FIR. In view of the prayer made by the learned counsel for the petitioner, I do not find any legitimate ground to interfere in the impugned order order dated 23.07.2024 (Annexure P-4) passed by the Court of learned Judicial Magistrate First Class, Bathinda, Punjab. Therefore, the present petition stands dismissed.
