(Oral) Petitioner is seeking direction to the respondents for endorsement of the correct date of birth i.e 08.03.1966 as per school record (P-5) instead of 15.06.1956 Petitioner is working as Chowkidar in the respondentDepartment and his date of birth is mentioned in the service book as 15.06.1956 instead of 08.03.1996. Reference has been made to letter dated 31.03.2016 whereby Head Master Government Middle School Village Attal, Tehsil Ganauar, District Sonepat has given the details of the petitioner regarding date of birth, wherein date of birth of the petitioner is written as 08.03.1966 at reference No. 444 (P-4). This fact is further clear from school leaving certificate dated 02.12.2011 (P-5). GAURAV ARORA 2016.06.03 15:18 I attest to the accuracy and integrity of this document

C.W.P No. 11679 of 2016 -2Respondent No. 5 re-verified the certificate by issuing letter to Block Education Officer Ganaur regarding the genuineness of the certificate. This fact is further clear from the copy of Aadhar card that the correct date of birth of petitioner is 08.03.1966 (P-9). Petitioner is going to retire on 30.06.2016.

Reference has been made to a judgment of Hon'ble the Supreme Court in a case of R.K. Jangra v. State of Punjab and others, 2009(4) SLR 93.

Learned counsel for the petitioner states, that at this stage, the petitioner will be satisfied, if directions are issued to respondents to decide the representation, referred to above. In view of above, without commenting on the merits of the case, this petition is disposed of with a direction to the respondents to decide the representation dated 28.03.2016 (P-6) of the petitioner for correction of date of birth, by passing a speaking order, in accordance with Rules/law, preferably within a period of 15 days from the date of receipt of certified copy of this order.
