(ORAL) The petitioner has filed this writ petition being aggrieved by a letter dated 22.03.2022 (Annexure P-9) issued by respondent No. 2 making adverse and unwarranted observation against the petitioner in respect of the quality of material allegedly supplied by it to respondent No. 5. Learned senior counsel, appearing for the petitioner, submits that in terms of the liberty granted by the respondent-authorities vide paragraph 3 of the letter/order dated 13.07.2022 (Annexure P-13 at page 86), the petitioner has already filed a representation dated 14.07.2022 (Annexure P-14) against the impugned order which is pending before them.

He further submits that the respondent-authorities may be directed to consider and decide the petitioner's representation before opening the financial bid. Learned senior counsel for the petitioner, after arguing at length, confines his prayer to this limited relief. Mr. Deepak Balyan, learned Additional Advocate General, Haryana, in response and on instructions from Mr. Mohit Kaushik, Assistant Director Supply and Disposal Department, Haryana, submits that the respondent-authorities would consider and decide the petitioner's representation before opening the financial bid. In view of the aforesaid prayer made by learned senior counsel for the petitioner as well as the statement of learned State counsel, the writ petition stands disposed of in terms thereof.

It is made clear that we have not expressed any opinion on the merits of the case and, therefore, the authorities would be at liberty to examine all the facts and facets of the matter and take a decision in accordance with law.
