HARSIMRAN SINGH SETHI, J. (Oral) Learned counsel for the petitioner submits that husband of the petitioner, namely, Shri Manbir Singh, unfortunately died on 29.05.2015, in an accident, after which the petitioner was granted the benefit of compassionate financial assistance from 30.05.2015 to 31.07.2020. Learned counsel submits that after 31.07.2020, the petitioner was entitled for grant of family pension, which benefit has not been extended to her, despite the fact that two years have already passed. Learned counsel submits that non-grant of family pension to the petitioner by the respondents is totally arbitrary and illegal.

Notice of motion.

Learned State counsel submits that prior to the filing of the present petition, the petitioner has not approached the concerned department seeking the relief as is being claimed by her in the present petition, hence, in PRASHANT KAPOOR 2022.07.22 18:42 I attest to the accuracy and authenticity of this order/judgment

CWP-15619-2022 case the petitioner files any representation before the concerned authority, raising her grievance for grant of family pension, the same will be considered in accordance with law and appropriate orders on the claim of the petitioner will be passed within a period of two months of the receipt of any such claim.

Faced with this situation, learned counsel for the petitioner submits that the present petition may kindly be permitted to be withdrawn with liberty to the petitioner to approach the respondents by filing appropriate representation claiming the relief for grant of family pension to the petitioner in respect of the service rendered by her late husband, namely, Shri Manbir Singh.
