Prayer in the present petition is to release the arrears of actual pay and other benefits from the date of regularization of the petitioners i.e. 1.4.2011, as the benefits were already released to similarly situated persons vide order dated 4.8.2014.

Learned counsel for the petitioners submitted that for claiming the relief, a legal notice dated 13.10.2014 (Annexure P-6) has been got served on the respondents, however, the same has not been responded to. It is further submitted that for the aforesaid claim, at this stage, the petitioners would be satisfied in case a direction is issued to respondent No.3 to decide the legal notice dated 13.10.2014 (Annexure P-6) got served by them, within specified time.

After hearing learned counsel for the petitioners and without going into the merit of the controversy, the present petition is disposed of at this stage with a direction to respondent No.3 to take a final decision on the legal notice dated 13.10.2014 got served by the petitioners. The needful shall be done within a period of four months from the date of receipt of copy of this order.
