* * * * S.J. VAZIFDAR, A.C.J. (ORAL) The petitioner applied for the allotment of a plot in the general category to which he belongs. The respondents inadvertently included him in the advocates' category to which he did not belong. The error admittedly was on the part of the respondents. The petitioner's application was correctly made. The petitioner was declared successful in the draw of lots under the advocates' category.

We are bound to grant the reliefs claimed by the petitioner in view of a judgement of the Division Bench of this Court dated 20.09.2013 in Shakuntla Vs Haryana Urban Development Authority, Panchkula and others (CWP-2519-2013) which in turn followed the judgement of another Division Bench of this Court in Virender Singh Vs Haryana Urban Development Authority, Manimajra, 1994(3) PLR 289.

In these circumstances, the petition is allowed.

The respondents shall issue the allotment letter in favour of the petitioner within one month from the date of receipt of a certified copy of this order. The same shall be subject to the petitioner complying with all other terms and conditions.
