In pursuance of the last order, the Warrant Officer has filed his report in a sealed cover. The same is opened and taken on record.

The respondent-State has filed response to the petition through Sucha Singh, PPS, Deputy Superintendent of Police, Special Branch and Criminal Intelligence, Amritsar (Rural). The same is also taken on record.

As per report dated 7.6.2023 of the Warrant Officer, the detenue was not found at the Police Station. Further, petitioner Vijay Kumar, who was accompanying the Warrant Officer, received a call from the detenue-Amandeep Singh, thereby he informed that he has returned back at home. The Warrant Officer also raided Police Station Jandiala Guru. The detenue was not found there. The CCTV cameras of the Police Station were not in working condition. 2023:PHHC:081855 CRWP No. 5598 of 2023 -2with regard to non-working of CCTV cameras was produced by the concerned official. The SHO of concerned Police Station submitted a report dated 2.6.2023, which is attached with the report of Warrant Officer, as Annexure-A, in which he has specifically mentioned that the alleged detenue Amandeep Singh son of Shivdayal Singh has not been arrested in any case nor he has been called in Police Station on 1.6.2023, in connection with any type of interrogation. The reply which has been filed by the State has also narrated the same thing. 4.

No one has come present on behalf of the petitioner. In pursuance of the report submitted by the Warrant Officer, since the alleged detenue was not found in illegal custody or detained by any one, rather he is at his house, no further action is required. Therefore, the present petition is rendered infructuous and is dismissed as such.
