Criminal Misc. Application bearing No.CRM-35064-2025, under Section 528 of BNSS, 2023, has been filed seeking withdrawal of the main case i.e. CRM-M-26359-2025, which is listed for 12.01.2026. 2.

In the main case, on 21.08.2025, following order was passed:- "1.

List again on 12.01.2026, to enable learned State counsel to file status report in the matter.

Let status report be filed by learned State counsel explaining therein involvement of the petitioner in the earlier incident including his roles."

Today, on the very outset, learned counsel submits that applicant-petitioner wishes to withdraw the main regular bail petition at this stage with liberty to approach the learned Trial Court for bail pending trial, as the complainant - Anil Kumar, on whose statement, FIR in question has been registered, is himself involved in a cross case wherein he has been attributed more serious injuries than the present applicant-petitioner. Further submits that Complainant - Anil Kumar has already been granted concession of bail pending trial by the learned Court below on 18.07.2025 (Annexure A-1), JAWALA RAM 2025.09.10 11:22 I attest to the accuracy and authenticity of this document

CRM-M-26359-2025 (O&M) - 2 - where, the applicant-petitioner has been attributed only blunt injuries, which have been declared simple in nature and no recovery of any firearm has been effected from his possession.

Therefore, learned counsel requests that the date of hearing in the main case, which is fixed for 12.01.2026 be also pre-poned for today itself, and then applicant-petitioner be allowed to withdraw the main case, i.e., CRM-M-26359-2025.

Mr. Neeraj Madaan, Sr. DAG, Punjab, who is present in Court, accepts notice on behalf of the non-applicant/respondent - State and pleads no objection to the prayer made therein.

In view of the prayer and the averments made in the application, which is supported by an affidavit of the applicant-petitioner, date of hearing in the main case is pre-poned from 12.01.2026 to today itself i.e. 08.09.2025, and same is taken on board for its disposal.

As a necessary corollary, the main petition i.e. CRM-M-263592025, is dismissed as withdrawn with liberty as sought in the application, and recorded here-above.
