G.S.SANDHAWALIA, J. (Oral) The petitioner seeks direction to the respondents to grant promotion as Assistant Executive Engineer (Civil) w.e.f. the date when his juniors were promoted. The relief claimed is on the basis that the order imposing punishment upon him has been set aside by the competent authority.

Counsel for the petitioner submits that vide order dated 15.05.2015 (Annexure P-6), punishment of stoppage of two annual increments with cumulative effect had been imposed upon him. However, in appeal, the same was set aside by the whole time Directors vide agenda dated 17.12.2015 and the formal order was thereafter passed on 25.04.2016 (Annexure P-7). He had accordingly submitted a representation to the CMD of the respondent-corporation dated 05.05.2016 (Annexure P-8) and thereafter also on 17.05.2016 (Annexure P-9) submitted another request. It is his case that promotions were also made on 16.05.2016 (Annexure P-10) but he has been left out. Counsel accordingly submits that he would be satisfied if time bound decision is taken by respondent no. 2 on SHIVANI GUPTA 2016.06.07 11:59 I attest to the accuracy and integrity of this document Chandigarh

CWP No. 11819 of 2016 -2representation dated 17.05.2016 (Annexure P-9). Accordingly, without commenting on the merits of the case, the present writ petition is disposed of with direction to respondent no. 2/competent authority to decide the representation dated 17.05.2016 (Annexure P-9) within a period of 3 months from the date of receipt of certified copy of the order. In case the petitioner is held entitled for the benefits, consequential benefits be also released to him from the due date. Needless to say if the relief is to be denied, reasoned order be passed and conveyed to the petitioner.
