RAMESHWAR SINGH MALIK, J. (Oral) Feeling aggrieved against the alleged inaction on the part of the respondent authorities, the petitioners have approached this Court by way of present writ petition under Articles 226/227 of the Constitution of India, seeking a writ in the nature of mandamus.

Notice of motion was issued and pursuant thereto reply has been filed by the respondents.

Heard learned counsel for the parties.

It has gone undisputed before this Court that a self-contained legal notice, dated 27.4.2013 (Annexure P-8), served by the petitioners on the respondent authorities, is still pending decision. Learned counsel for the petitioners fairly states that the petitioners shall be satisfied in case the Prashant Kapoor 2016.08.19 14:31 I attest to the accuracy and authenticity of this document

CWP-13494-2014 (O&M) Deputy Commissioner, Ludhiana, is directed to consider the grievance of the petitioners and pass an appropriate order on Annexure P-8, within a reasonable time.

Learned counsel for the respondents also fairly state that they have got no objection in case an appropriate direction is issued to the Deputy Commissioner, Ludhiana, for passing an order on the legal notice issued by the petitioners.

After hearing learned counsel for the parties and without commenting on the merits of the case, least it should prejudice the rights of the parties, the present writ petition is disposed of with a direction to the Deputy Commissioner, Ludhiana, to consider the grievances raised by the petitioners in their legal notice, dated 27.4.2013 (Annexure P-8), at an early date by passing an appropriate order thereon, strictly in accordance with law and after granting an opportunity of being heard to all the interested parties, but in any case within a period of three months from the date of receipt of a certified copy of this order.

With the above said and direction issued, the present writ petition stands disposed of.
