-.- KARAMJIT SINGH , J. (Oral) Prayer is for grant of anticipatory bail in case having FIR No.58 dated 26.4.2022 registered under Sections 306/34 IPC at Police Station PAU, District Ludhiana.
The allegations in nut-shell are that deceased-Ramandeep Singh performed marriage with Kirandeep Kaur daughter of the present petitioner and deceased committed suicide on 25.4.2022 and before ending his life, he left behind one suicide note, in which, he blamed his wife and in-laws for his death.
Counsel for the petitioner has inter alia contended that actually there was love marriage between the deceased and daughter of the petitioner and they also took protection from the Court and that petitioner and his daughter are not responsible in any manner for the death of deceased Ramandeep Singh and further the daughter of the petitioner has already given concession of anticipatory bail by this Court vide order dated GAURAV SOROT 2023.02.14 11:18 I attest to the accuracy and authenticity of this order, judgment and documents.
( 2 ) CRM-M-32102-2022 1.12.2022 and the copy of the same is taken on record. The counsel for the petitioner has further contended that the petitioner has joined investigation with the police by virtue of previous order of interim bail passed by this Court.
State counsel on instructions from ASI Amrik Singh has not refuted the aforesaid assertions made by counsel for the petitioner with regard to joining of investigation by the petitioner and further submits that alleged suicide note has already sent to the CFSL for examination and its report is still awaited. The State counsel has also not disputed the fact that co-accused Kirandeep Kaur wife of the deceased has already enlarged on anticipatory bail by this Court vide order dated 1.12.2022. The copy of the suicide note in question is available on the record, wherein it is stated to be written by the deceased that his only fight is with his wife and in-law's family.
It is a matter of evidence as to whether the petitioner had driven the deceased to end his life by committing suicide. In view of the above, without commenting on the merits of the case, the present petition is hereby allowed and order dated 26.7.2022 is hereby made absolute. The petitioner should abide by the conditions envisaged under Section 438(2) Cr.P.C.
