(Oral) The petitioner has filed this petition under Articles 226/227 of the Constitution of India, for issuance of a writ of certiorari for quashing the order dated 08.03.2022 (Annexure P-2) passed by respondent No.3 vide which the petitioner has been transferred from Chief Engineer, Slapper Division, BBMB, Slapper (Himachal Pradesh) to the Chief Engineer, Bhakhra Dam, BBMB, Nangal, District Ropar (Punjab); along with certain other prayers.
The counsel for the petitioner submits that earlier the petitioner had approached the High Court of Himachal Pradesh, Shimla for the same cause of action. However, the writ petition was withdrawn to avail any other appropriate remedy available to the petitioner. Since the petitioner had once approached the High Court of Himachal Pradesh and the writ petition was not dismissed on the ground of jurisdiction, therefore, it would not be appropriate for this court to proceed further with the case for the same cause of action. CWP No.15462 of 2022 -2At this stage, the counsel for the petitioner submits that he be permitted to withdraw the present petition to approach the High Court of Himachal Pradesh once again.
