Gurjant Singh and others ............Petitioners vs State of Punjab and others .............Respondents CORAM:- HON'BLE MR.JUSTICE JASWANT SINGH Present:- Mr.Vikas Singh,Advocate with Mr.TS Sidhu,Advocate for the petitioners Jaswant Singh,J(Oral) Petitioners, 79 in numbers are are stated to be engaged on contract basis by a Contractor for undertaking works at various tubewells operated through Punjab Water Supply and Sewerage Board and situated within the territorial jurisdiction of Municipal Corporation,Sangrur and Mansa. Their prayers in the present petition under Article 226 of the Constitution is for a mandamus directing the State to frame a policy for regularization of their services, as they are stated to have been engaged for periods almost more than ten years.

After hearing learned counsel for the petitioners, no case for issuance of any direction is made out.

It is a conceded case that petitioners have never been engaged either by the State Government or by any statutory body owned and controlled by the State. Thus,there is no privity of contract between the petitioners and the State Government.

At the time of hearing nothing has been shown which mandates the State Government to issue a regularization policy for such workers who are engaged by independent contractors.

Dismissed.
