1. The petitioner seeks grant of regular bail in a case registered vide FIR No.163 dated 11.8.2020 under Sections 379-B/34 IPC and Section 25/54/59 of Arms Act at Police Station Bilaspur, District Yamuna Nagar.

2. The FIR in question was lodged at the instance of Paramjit Singh wherein allegations are to the effect that the petitioner alongwith other accused had waylaid the complainant and had given beatings and had snatched an amount of ` 5,200/- from the complainant.

3. The learned counsel for the petitioner has submitted that the FIR came to be lodged on account of some misunderstandings which have now been resolved and a compromise has now been effected and infact a petition for quashing of FIR on grounds of compromise has already been filed. CRM-M-29610-2020 (O&M) learned counsel has drawn the attention of this Court to the compromise deed, annexed with the petition as Annexure P-2.

Opposing the petition, the learned State counsel has submitted that since the petitioner is specifically named in the FIR and there are serious allegations against the petitioner, no case for grant of bail is made out. It has, however, been informed that the petitioner has been behind bars since the last 1 1⁄2 month. The learned State counsel has not disputed the fact that a petition for quashing of FIR on grounds of compromise has been filed. The learned State counsel, upon instructions from SI Chanderpal, has informed that the petitioner is not wanted in any other case.

5. Having regard to the facts and circumstances of the case and the fact that the matter is stated to have been compromised and the petitioner is not stated to be wanted in any other case, the petition merits acceptance and the petitioner is ordered to be released on regular bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
