The petitioner is seeking quashing of order of proclamation dated 24.02.2025 passed by learned Judge Special Court, Ludhiana whereby the petitioner has been declared as a proclaimed offender in FIR No.379 dated 21.10.2020 under Section 22 of NDPS Act, 1985 registered at Police Station Division No.8, District Police Commissionerate, Ludhiana.

Learned counsel for the petitioner contends that the petitioner is facing trial in the aforementioned FIR and was on bail. However, he failed to appear before the Court concerned as no notice was served upon the petitioner by the Court concerned and further the petitioner was suffering from Typhoid fever and was advised bed rest. Consequently, his bail was cancelled and his bail bonds and surety bonds were forefeited to the State and warrant of arrest of the petitioner were issued following which, vide order dated 24.02.2025, he was declared as a proclaimed offender.

Learned counsel for the petitioner, on instructions submits that the petitioner undertakes to appear before the trial Court concerned on each and every date and shall not seek any exemption for his personal appearance on any date of hearing before the trial Court. He is willing and ready to join the trial proceedings.

I have heard learned counsel for the parties and perused the material placed on record.

No ground is made out to interfere in the impugned order dated 24.02.2025 and the present petition is hereby, disposed of. 8.

However, the petitioner is directed to appear and surrender before the trial Court concerned within a period of 07 days from today and may file bail application before the concerned Court. In case, he does so, the same be considered by the trial Court concerned, in accordance with law, on the same date, if he appears at 10.00 A.M.
