At the outset, learned counsel for the petitioner submits that since the challan has been presented before the Court below, he be granted permission to withdraw the present petition, with a liberty to raise all the pleas, as in this petition, before the Court below. Learned State counsel and learned counsel for respondent No.5 have no objection to the aforesaid limited prayer made by the learned counsel for the petitioner.

In view of the above, the present petition is dismissed as withdrawn, with the liberty aforesaid.
