NIDHI GUPTA, J. (ORAL) Challenge in the present revision petition is to the order dated 16.11.2016, passed by the learned Family Court, Hisar, directing the petitioner to pay final maintenance to the tune of Rs.2000/- per month to respondent No. 1-wife and Rs.5000/- per month each to respondents No. 2 and 3. The petitioner was further directed to pay a sum of Rs.3300/- towards litigation expenses. Perusal of the order sheets shows that earlier the instant revision petition was dismissed for non-prosecution vide order dated 31.08.2018 and subsequently, vide order dated 17.09.2018, the same was ordered to be restored to its original number subject to deposit of Rs.2500/- as costs with the High Court Legal Services Committee. However, on the next date of hearing i.e. 10.12.
2018, the petitioner had not deposited the aforesaid costs and learned counsel for the petitioner had sought an adjournment and the case was adjourned to 18.03.2019. As per office report dated 18.03.2019, the aforesaid costs of Rs.2500/- was deposited by the petitioner. However, on the next date of RISHU KATARIA 2023.08.
CRR(F)-338-2017 (O&M) -22023:PHHC:106515 hearing i.e. 14.11.2022, the case was again adjourned at the request of learned counsel for the petitioner.
Today, the petitioner has gone un-represented. The case pertains to the year 2017. Therefore, it can safely be presumed that the petitioner or his counsel is not interested in pursuing the instant revision petition.
In view of the above, the instant revision petition is dismissed for non-prosecution.
