The present petition has been filed under Article 226/227 of the Constitution of India praying for issuance of a writ in the nature of mandamus directing the respondents to pay the complete retiral benefits in all heads to the petitioner arising out of her service along with complete arrears and it is further prayed that the petitioner is also entitled for interest on the delayed payment of all the retiral benefits and other arrears from the

 date when the same became due, till its realization in view of Full Bench judgment rendered by a Full Bench of this Court in A.S. Randhawa Supdg. Engineer (Retd.) vs. State of Punjab 1998 (1) SCT 343. 2.

At the outset, learned counsel for respondents No. 3 and 4 submits that all admissible dues shall be paid to the petitioner by 15.09.2026.

Learned counsel for the petitioner submits that the petitioner is also entitled to interest on account of the delay in releasing his retiral dues, in light of A.S. Randhawa's case (supra), and further prays that the respondents be directed to furnish a complete breakdown of the payment of the admissible dues.

Having heard the submissions made by learned counsel for the parties and after perusing the record with their able assistance, it transpires that the petitioner retired from service on 28.02.2025 and that there were no pending disciplinary proceedings on the eve of his retirement. There has been an inordinate delay in the release of his retiral dues; therefore, his case is squarely covered by the judgment rendered by the Full Bench of this Court in A.S. Randhawa's case (supra), wherein it was held that disbursement of pension and other retiral benefits must be made in a timely manner. Any delay beyond a period of two months in such disbursement

+ would entitle the retired employee to claim interest on the amount due. Further, since respondents No. 3 and 4 have undertaken to release the admissible dues by 15.09.2026, the present writ petition is disposed of with a direction to the respondents to pay the pending retiral dues along with interest @ 6% per annum. Such interest shall be calculated from the expiry of two months from the date of retirement until the date of actual payment. The needful shall be done within a period of three months from the date of receipt of a certified copy of this order.
