IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH

Sr. No.105 LPA-1464-2024 Date of decision : 07.11.2024 Prakash Chandra Trivedi ..... Appellant

Versus

State of Haryana and others ..... Respondent CORAM :

HON'BLE MR. JUSTICE DEEPAK SIBAL HON'BLE MR. JUSTICE DEEPAK MANCHANDA Present :

Mr.Sumit Kalyan, Advocate, for Mr.G.S.Madaan, Advocate, for the appellant.

* * * * * DEEPAK SIBAL, J. (Oral) 1.

On 30.09.2019 the appellant retired as a Deputy Ranger, Department of Forests, Haryana. Retiral benefits were not released to him on account of pending departmental proceedings against him but since all such proceedings were later dropped he approached this Court seeking issuance of directions to the respondents to release his retiral benefits alongwith interest. After considering the facts placed on the record and the law on the subject the learned Single Judge found merit in the appellant's claim and resultantly issued directions to the State to release all his dues/retiral benefits alongwith 6% interest per annum from the date the said amounts became due till they are actually disbursed to him. 2.

Through the instant appeal the appellant seeks higher rate of interest than the interest granted to him through the impugned judgment. 3.

After hearing learned counsel for the appellant and going through the record of the case, we find that in the facts of the present case the rate of interest @ 6% per annum granted to the appellant from the day his retiral benefits were due to him till the date they are disbursed to him is reasonable, warranting no interference. 4.

Dismissed.
