Vide this petition, the petitioner seeks the concession of 'regular bail' under the provisions of Section 439 of the Cr.P.C., upon FIR no.88, dated 29.05.2021, having been registered at Police Station Civil Lines, Bathinda, alleging therein the commission of offences punishable under Sections 15(c), 25/29 of the NDPS Act, 1985.

Learned counsel for the petitioner submits that obviously the petitioner is not named in the FIR as the person from whom 54 kgs. of poppy husk is alleged to have been recovered and with the petitioner only named in the alleged secret information received that he alongwith Gurpreet Singh was selling poppy husk.

Thereafter on reaching near the car only one young person was found to be sitting in the car.

#    , it is an appropriate case where in terms of Section 37 (1) (b) (ii) of the NDPS Act, 1985, the petitioner should be admitted to bail. Consequently, the petition is allowed and the petitioner is ordered to be released on bail, subject to his furnishing adequate bail bonds and surety bonds to the satisfaction of the trial court/Duty Magistrate concerned.
