Tribhuvan Dahiya, J (Oral) The petition has been filed, inter alia, seeking a writ of certiorari quashing the order, dated 03.05.2024, Annexure P-7, whereby the petitioner's claim has been declined on the ground that she acquired the requisite qualification of M.A. English on 10.01.2022. 2.

Learned counsel for the petitioner contends that the order has been passed on wrong facts as the petitioner passed M.A. English on 19.11.2021, as is apparent from the Detailed Marks Certificate, Annexure P8. Therefore, she was entitled to be considered for promotion, when her juniors were promoted on 08.01.2021 and 13.04.2022, as she had acquired the requisite qualification prior to the cut-off date, i.e., 30.11.2021. 3.

Learned State counsel is not in a position to dispute the facts aforementioned. He, however, contends that the impugned order, dated 03.05.2024, will be withdrawn within one week and a fresh order will be passed by the second respondent, after considering the petitioner's AVIN KUMAR 2024.08.01 18:45 I attest to the accuracy and integrity of this judgment/order.

In view of the statement made by learned State counsel, learned counsel for the petitioner has no objection to the petition being disposed of in terms thereof.
