(ORAL) Jaspreet Kaur and Gurdeep Singh, the petitioners before me, claim themselves to be major. They have pleaded that they have married against the wishes of respondents No. 4 to 6 and seek protection to their life and liberty. They apprehend danger from respondents No. 4 to 6. They have placed on record marriage certificate and photographs, Annexures P-3 and P-4, respectively evidencing their marriage.
Learned counsel for the petitioners has submitted that the petitioners have sent the representation to respondent No. 3 through registered post but the same has not been annexed with this petition. Without entering upon an exercise to evaluate the evidentiary value of the documents placed on the file, in case the petitioners approach Senior Superintendent of Police-respondent No. 2 by way of a representation, within one week from today, for protection of their life and liberty, the same be looked into by respondent No.2 and if required, GURPREET SINGH 2019.06.18 19:03 I attest to the accuracy and authenticity of this document chandigarh
CWP No. 16880 of 2019 -2necessary protection be provided to them. It is made clear that this order shall not be taken to protect the petitioners from legal action for violation of law if any committed by them.
The petitioner stands disposed of.
It has been observed by this Court that the Sikh priest from Gurudwara Guru Nanak Niwas Sahib, Village Karor Kalan, Tehsil Kharar, District Mohali has been performing Anand Karaj ceremony of the run away couples even though the couples are not being accompanied by their relatives. It has been also found in some cases that the parties are not of marriageable age but still their marriage is performed by the said Sikh priest.
Therefore, SHO, P.S. Kharar, Mohali is directed to produce the said Sikh priest Kulbir Singh of Gurudwara Guru Nanak Niwas Sahib, Village Karor Kalan, Tehsil Kharar, District Mohali and priest Mohinder Pal Singh of Gurudwara Dashmesh Pita Patshahi, Village Nadha Singha Devi, Tehsil Kharar in the Court on 19.6.2019. Copy of the order be given to the learned State counsel under the signatures of Reader of this Court.
