Cr. Misc. No.20108 of 2019:

For the reasons mentioned in the application, the documents (Annexures-P.5 to P.8) attached with the application are taken on record subject to just all exceptions.

The criminal miscellaneous application is allowed. Cr. Misc. No.M-26978 of 2019:

The petitioner has filed this petition under Section 438 Cr.P.C.

Cr. Misc. No.M-26978 of 2019 [2] for grant of anticipatory bail in case FIR No.0060 dated 15.6.2018 registered for the offence under Section 420 IPC at Police Station Bareta, District Mansa.

Notice of motion has been issued.

Mr. Prabhjot Singh Walia, learned Assistant Advocate General, Punjab has appeared on behalf of the respondent-State and Mr. J.S. Khivo, learned Advocate has appeared for the complainant and contested this petition.

I have heard learned counsel for the parties as well as learned State counsel and have gone through the record. From the record, I find that the FIR in the present case has been got registered by the complainant against the present petitioner, Gurdev Singh, Baldev Singh and Balwinder Singh on the ground that they have committed cheating on the pretext of giving job to grand-daughter of Dalip Singh. As per the complainant, his grand-daughter Harpreet Kaur got passed B.A. and Rajeshwar alias Raju came to his house and asked him to directly get his grand-daughter selected as ASI. As per the allegations, `5 Lakhs were handed over to Rajeshwar alias Raju, who handed over the money to his co-accused Gurdev Singh, Baldev Singh and Balwinder Singh etc.

Keeping in view the serious allegations against the present petitioner and the fact that he is required for custodial interrogation, I do not find it a fit case where the petitioner is entitled for the grant of anticipatory bail.

Therefore, finding no merit in this petition, the same is

Cr. Misc. No.M-26978 of 2019 [3] dismissed.
