The petitioner, who is involved in FIR No.148 dated 31.8.2019 registered at Police Station Division No.3, Ludhiana under Sections 21, 61 and 85 of Narcotic Drugs and Psychotropic Substances Act, 1985, seeks grant of interim bail so as to look after his mother who is stated to have been suffered a stroke of paralysis.

Vide order dated 1.10.2020, this Court had directed the State to verify the averments made in the petition as regards the ailment of petitioner's mother. 3.
The State has filed an affidavit of Sh. Waryam Singh, PPS, Assistant Commissioner of Police (Central), Ludhiana, wherein the factum of petitioner's mother having suffered a stroke of paralysis has been found to be PANKAJ KAKKAR 2020.12.01 17:37 I attest to the accuracy and integrity of this document
( 2 ) CRM-M-29637-2020 (O&M) correct. It has, however, been reported in the medical certificate (Annexure R-1) that the petitioner's mother is, however, not bed ridden and can walk with the help of a walker.

The learned State counsel has informed that the petitioner as on date has been behind bars since the last 1 year, 2 months and 19 days and that the petitioner is not involved in any other case. 5.
Having regard to the facts and circumstances of the case especially that it has been verified that the petitioner's mother has suffered a stroke of paralysis and also that the petitioner has been behind bars since the last 1 year, 2 months and 19 days and he is not stated to be involved in any other case, the petition is accepted and the petitioner is ordered to be released on interim bail for a period of 3 months from today subject to his furnishing bail bonds/surety bonds to the satisfaction of learned Trial Court/Chief Judicial Magistrate/Duty Magistrate concerned. It is directed that the petitioner, after availing interim bail, shall surrender before the jail authorities on 1.3.2021. 6.
The petition stands disposed of accordingly.
