***** RAMENDRA JAIN, J. (ORAL) CRM-503-2019 Through this application under Section 147 of the Negotiable Instruments Act, 1881 as amended up to date read with Section 482 Cr.P.C. (for short, "Act"), the applicant-petitioner has sought compounding of offence in view of the compromise between him and complainant-respondent No.2.
In compliance of order dated 04.10.2018, the applicantpetitioner has already deposited 15% of the cheque amount in terms of the guidelines laid down in "Damodar S. Prabhu v.Sayed Babalal H.", 2010 (15) SCC 663, as is clear from order dated 15.10.2018 with the SONIKA 2019.01.14 09:57 I attest to the accuracy and authenticity of this document Chandigarh

Learned counsel for respondent No.2 has no objection to the compounding of offence and setting aside the judgments of appellate court and trial court against the petitioner in view of the alleged compromise between them.
In view of the above, the applicant-petitioner is permitted to compound the offence.
CRM stands disposed of.
CRR-2781-2018 Since, complainant-respondent No.2 has no objection to the compounding of offence and setting aside of judgments of both the courts below, therefore, impugned judgment dated 02.08.2018 passed by first appellate court and judgment of conviction and order of sentence dated 10.10.2016 of the trial court are hereby set aside.
