(ORAL) Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing FIR No. 108 dated 10.06.2021 (Annexure P-1) registered under Sections 420 and 406 IPC and Section 13(1) of the Punjab Travel Professionals Act, 2014, at Police Station Subhanpur, District Kapurthala and all the subsequent proceedings arising therefrom, on the basis of compromise dated 21.08.2021 (Annexure P-2), effected in between the parties.

Pursuant to orders dated 26.08.2021, of this Court, the parties appeared before the Judicial Magistrate Ist Class, Kapurthala, on 02.09.2021 to get their statements recorded. Learned Judicial Magistrate Ist Class, Kapurthala, submitted her report along with copies of statements of the parties vide letter No. 530 dated 07.10.2021, duly RISHU KATARIA 2021.11.02 10:32 I attest to the accuracy and integrity of this document Chandigarh

According to the report, learned Judicial Magistrate Ist Class, Kapurthala, is satisfied that compromise effected between the parties is genuine, voluntarily, without any undue influence, coercion and threat from any quarter. There is no other accused except petitionerAjaypal Singh and he has not been declared as proclaimed offender. Considering the report of Judicial Magistrate Ist Class, Kapurthala, dated 07.10.2021 and the fact that the compromise will bring peace and harmony between the parties, aforesaid FIR No. 108 dated 10.06.2021 (Annexure P-1) and all subsequent proceedings arising therefrom, are quashed, qua the petitioner only.
