The petitioner apprehending arrest in the FIR captioned above, had come up before this Court under Section 438 CrPC seeking anticipatory bail. 2.
The petitioner is working as a Clerk in the office of Municipal Corporation and the allegations are of tempering with the property register, which resulted in change of ownership.

Petitioner's counsel submits that on 21.09.2023, petitioner was directed to declare his assets. Although this Court had modified the above said order but he was voluntarily ready to handover the affidavit regarding declaration of assest to show his bona fide. He has handed over the affidavit to the State counsel in the Court. He further submits that he shall not take such declaration as self incrimination, violation of Article 20/21 of the Constitution of India or any other fundamental right/law. He also submits that the petitioner had already joined the investigation. 4.
State counsel does not refute the claim of petitioner. 5.
Given entirety of facts and circumstances of the case, particularly the bona fide conduct of the petitioner voluntarily declaring the assets to prove his innocence, the present petition is allowed and interim order dated 06.06.2023 is made absolute.
