This is a petition for anticipatory bail filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, (BNSS), 2023 in case bearing FIR No.31 dated 11.04.2025 under Sections 196, 298, 302, 61(2) of the Bhartiya Nyaya Sanhita, 2023 and Section 67 of the Information Technology Act, 2000, registered at Police Station Cyber Crime, Chandigarh. 2.
The case of the prosecution is that the petitioner has participated in an online video conference on social media platform i.e. instagram and has used a filthy language which constitutes the offences as stated in the FIR. The stand taken by the petitioner is that this is a case of mis-identity and he is not the person who is seen in the screenshot of the video conference Annexure P-4. The bearded person, who is seen in the video conference on instagram appears to be different from the petitioner. The Aadhar Card attached as Annexure P-6 of the petitioner also seems to be of a different person. 3.
Learned counsel for the petitioner contends that the petitioner has been falsely implicated in the present case.

Vide order dated 19.05.2025, this Court had directed the petitioner to appear before the Investigating Officer and to join investigation and in the event of his arrest, he was ordered to be released on ad-interim bail to the satisfaction of the Investigating/Arresting Officer, subject to the conditions envisaged under Section 482 BNSS.

Learned State counsel on instructions states that the petitioner has joined the investigation and is not required for custodial interrogation. 5.
In view of the submissions of learned counsel for the petitioner especially when the petitioner has cooperated with the investigation officer, the order dated 19.05.2025 granting interim bail to the petitioner is made absolute. 6.
However, the petitioner shall abide by the conditions stipulated under Section 482 BNSS. He shall also join investigation as and when called upon to do so.

The petition stands allowed.
