*** MANOJ BAJAJ, J.(ORAL) This petition has been filed by the petitioner under Section 438 Code of Criminal Procedure for grant of anticipatory bail in case FIR No.32 dated 29.05.2019 under Sections 457 and 380 IPC, 1860, registered at Police Station Jaurkian, District Mansa. The petitioner apprehended his arrest at the hands of Police.

Learned counsel for the petitioner has invited the attention of the Court to the order dated 19.06.2019 whereby while issuing notice of motion to the respondent-State, the interim protection was extended to the petitioner. The said order reads as under:- "Instant petition has been filed under Section 438 Cr.P.C., seeking concession of pre-arrest bail to the petitioner in case FIR No.32 dated 29.05.2019, under Sections 457 and 380 IPC registered at Police Station Jaurkian, District Mansa.

FIR has been registered on the complaint of one Litesh Kumar on the allegation that one machine valued Rs. 1,50,000/- has been stolen from the premises of a rice mill by the present petitioner and also two other coaccused namely Manga Singh and Darshan Singh. It is inter alia contended that the complainant has Sheetal Gawri 2019.10.18 18:17 I attest to the accuracy and integrity of this document Chandigarh

CRM-M-27013-2019 (O & M) -2no concern with the rice mill in question and which has been locked and is under possession of the Food and Civil Supplies Department, State of Punjab. Furthermore, there is no basis for the allegations that had been raised. It is further contended that the petitioner has clean antecedents and is ready and willing to join investigation.

Notice of motion returnable for 16.10.2019.

In the meanwhile, petitioner is directed to join investigation.

In the event of arrest, the petitioner shall be released on interim bail subject to the satisfaction of the Arresting Officer/Investigating Officer. The petitioner shall join investigation as and when called upon to do so and he shall remain bound by the conditions as envisaged under Section 438(2) Cr.P.C. "

Learned counsel for the petitioner further contends that in deference to the said order, the petitioner submitted himself before the Police and joined the investigation. According to her, the petitioner cooperated with the Police Authorities during the investigation and furnished requisite bonds to the satisfaction of the Investigating Officer/Arresting Officer.

Learned State counsel does not dispute this fact that the petitioner has joined the investigation. He further states that the petitioner is not required for custodial interrogation for the time being.
