The present petition has been filed under Section 482 read with Section 439(2) Cr.P.C. for cancellation of regular bail granted to respondent No.2, vide order dated 06.05.2023, passed by learned Additional Sessions Judge, Charkhi Dadri in FIR No.235 dated 17.11.2022, registered under Sections 302, 323, 325 of Indian Penal Code at Police Station Jhojhu Kalan, District Charkhi Dadri.

Learned counsel for the petitioner submits at the outset, that while granting bail to respondent no.2, observations have been made by the trial Court on the merits of the case that shall prejudice the complainantpetitioner and will adversely affect the trial. 3.

CRM-M-37680-2023 has apprised this Court that now the case is fixed for arguments on charge and there is no complaint against the accused-respondent No.2 of having misused the concession of bail.

Considering the aforesaid and to ward off the apprehensions as expressed by the learned counsel for the petitioner, it is clarified that the observations made by the trial Court while granting bail shall have no bearing whatsoever, on the merits of the case. The trial Court shall proceed uninfluenced therefrom.

Disposed of accordingly.
