CRM-M No. 36335 of 2021 -2Learned counsel for the respondent (Union of India) submits that the hard copy of reply is being sent to the Registry of this Court today itself.

During course of arguments, learned counsel for the respondent (Union of India) concedes that the impugned order is not legally sustainable.

Both the learned counsel for the parties have arrived at a consensus that the impugned order and all consequential proceedings undertaken in pursuance thereof be set aside and trial Court be given liberty to proceed afresh in accordance with law.

Having considered the issue in the light of submissions recorded in the order dated 14.09.2021 and now in view of unanimity arrived at between the parties regarding unsustainability of impugned order, I deem it appropriate to quash the impugned order along with all consequential proceedings thereto, however with liberty to the trial Court to proceed afresh in accordance with law.

Disposed of.
