This petition has been filed under Section 482 of BNSS, 2023, seeking anticipatory bail in case FIR No.02 dated 21.03.2025, registered at Police Station Cyber Crime, District Khanna, under Section 67-B of the Information Technology Act, 2000 and Section 15(1) of the Prevention of Children from Sexual Offences Act, 2012. 2.

On 15.05.2025, the following order was passed:- "XX XX XX XX [2] Learned counsel for the petitioner submits that as per the allegations, 02 tiplines against the petitioner and another person, namely, Sukhpreet Singh, were received regarding Instagram username simranpal.singh.9465 (Mobile No.8194968909) with the allegation that petitioner is indulging in downloading and storing child pornographic material. Vide Report No.2 dated 24.12.2024, a Police Inspector contacted the

petitioner. The petitioner fully cooperated and handed over his mobile phone to the Police Officer. Upon physically checking the mobile phone, no pornographic material was found, however, as per the technical report by the Range Level Cyber Investigation and Technical Support Unit, Ludhiana, it was found that at one point of time, some child pornographic material was downloaded. Learned counsel for the petitioner vehemently contends that it was an accidental download, which was never forwarded to anyone from his mobile phone and was immediately deleted. The petitioner is ready to join the investigation. [3] Notice of motion.

[4] On advance notice, Ms. Ramta Chowdhary, DAG, Punjab, appears on behalf of the respondent-State and seeks time to file status report.

[6] In the meanwhile, in the event of the arrest of the petitioner, he shall be released on interim bail, on his furnishing bail bonds and surety bonds to the satisfaction of the arresting officer/Area Magistrate and also subject to the following conditions:- (i) That the petitioner shall further make himself available for interrogation by a police officer as and when required.

(ii) That the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer.

(iii) That the petitioner shall not leave India without the prior permission of the Trial Court/CJM concerned."

Learned State counsel, on instructions from SI Narpinder Pal Singh, at the very outset, informs the Court that the petitioner has joined the investigation and his custodial interrogation is not required. 4.

In view of the statement of learned State counsel, order dated 15.05.2025 is hereby made absolute. The petitioner shall abide by the terms and conditions envisaged under Section 482(2) of BNSS (erstwhile Section 438(2) of the Code of Criminal Procedure, 1973). 5.

The petition stands disposed of.
