Jaswant Singh,J(Oral) Petitioner possesses degree of Master of Business Administration (hereinafter referred to as MBA). By filing the present petition under Article 226 of the Constitution, he is seeking a mandamus directing the State Transport Authority/Punjab Public Service Commission to consider his candidature for the post of General Manager, Punjab Roadways pursuant to the three posts advertised vide Advertisement dated 10.3.2016 (P-2) for which last date for receipt of applications was concededly fixed as 18.4.2016.

It is not disputed that post of General Manager, Transport Department is covered by statutory Rules-Punjab,Department of Transport, Commercial Wing (Class-I)Service Rules,1985 as amended from time to time and inter alia lays down degree in Masters of Business Management (hereinafter referred to as MBM) as one of the essential qualifications for direct recruitment. The petitioner thus, not being eligible did not apply. The basis for seeking indulgence is that in the past the Punjab Government has permitted Sarv Shri S.S.Mann, Narinderpal Singh and M.R.Farooki as RAJINDER PRASHAD JOSHI 2016.07.

CWP 12176/2016 eligible and suitable for the post of General Manager on the basis of their possessing degree of MBA instead of MBM. It is,however,not disputed that the said fact is alleged to have happened around more than ten years back. After arguing for sometime, learned counsel for the petitioner prays for permission to withdraw the present petition. Dismissed as withdrawn.
