Petitioner has filed this petition under Section 482 Cr.P.C. for quashing of orders dated 10.05.2022 whereby the bail of the petitioner has been cancelled, his bail/surety bonds were remitted and he has been directed to be summoned through non-bailable warrants. The petitioner is an accused in case FIR No. 101 dated 24.05.2018 registered under Sections 22, 29 of NDPS Act and Sections 379 & 411 IPC at Police Station City Moga, District Moga. The petitioner was granted bail by this Court vide order dated 17.12.2019 in CRM-M- 32333 of 2019. Thereafter, the petitioner has been regularly appearing before the trial Court, however, on 10.05.2022 he could not appear before the Court because of which the impugned order was passed.

CRM-M-31382-2022 Learned counsel for the petitioner states that the absence of the petitioner was not intentional. In fact, father-in-law of the petitioner Beant Singh had died on 06.05.2022. Being son-in-law, the petitioner remained busy in performing the last rites of his father-in-law. The petitioner is ready to appear before the trial Court and face trial. Notice of motion.

Mr. B.S. Sewak, Ld. Addl. A.G., Punjab accepts notice. This petition is disposed of with a direction that petitioner may appear before trial Court on or before the next date i.e. 12.08.2022. On his doing so, he shall be admitted to bail by trial Court to its satisfaction. The petitioner shall also file an undertaking to appear before the trial Court on each and every date of hearing. Till then the execution of the non-bailable warrants of arrest shall remain stayed. It is made clear that in case the petitioner does not appear in the trial Court on or before the date fixed, this petition is liable to be dismissed.
