(Oral) Petitioner by way of present petition is seeking quashing of order dated 20.11.2012 (Annexure P-1) whereby he has been discharged from his services as guest teacher on the ground that he has attained the age of retirement i.e. 58 years.
As per affidavit of District Elementary Education Officer dated 07.04.2015 the petitioner joined as S.S. Master Guest Faculty in Government Senior Secondary School Sehlanga on 21.12.2005. After completing superannuation he was relieved on 31.10.2012. Thereafter, some clarification was sought from the Head Office vide letter dated 05.10.2012 that whether the guest faculty who have crossed the age of 58 years should be allowed to continue or not. CWP No.1639 of 2013 (O&M) -2petitioner be relieved from duty immediately. In this regard, a letter dated 06.04.2015 has been placed on record with the said affidavit whereby the Director Secondary Education has clarified that if some Guest Faculty Teachers, who have completed 58 years of age and are still continuing in service, they should be relieved forthwith and responsibility for their continuance in service should be fixed.
