(ORAL) The petitioner herein seeks the relief of regular bail in the criminal case registered at Police Station Sadar Sangrur, vide the FIR bearing No.49 dated 11.05.2022 under Sections 295/295-A IPC, with the allegations that he was involved in an incident of sacrilege of Gutka Sahib. 2.
Mr. Sandeep Singh Deol, learned Deputy Advocate General, Punjab, has appeared in this case in pursuance of the notice of the instant petition having been sent to the respondent-State in advance. 3.
I have heard learned counsel for the petitioner as well as learned State counsel in the instant petition and have also perused the file carefully. 4.
Learned counsel for the petitioner contends that the petitioner is in custody in this case since 13.05.2022 and the offences are triable by the Court of the Magistrate and the Challan has already been presented in the Court and moreover, the petitioner is not involved in any other criminal case of the similar nature and in these circumstances, he (petitioner) deserves the relief as SEEMA SHARMA 2022.07.27 18:21 I attest the accuracy and authenticity of this order/judgment

Learned State counsel does not dispute the afore-referred factual position.

Keeping in view the above-discussed facts and circumstances and also the fact that the trial of the case is likely to take sufficient time to conclude and without commenting or expressing any opinion on the merits of the case, the petitioner named Sher Singh is ordered to be released on regular bail subject to his furnishing the requisite personal and surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
