(Oral) Learned counsel for the petitioner submits that the case of the petitioner is squarely covered by the judgment of learned Single Bench of this Court passed in CWP No.19266 of 2010 titled as Satyapal Yadav and another vs. State of Haryana and another decided on 25.07.2012. Said judgment has been upheld by the LPA Bench and thereafter, SLP filed by State has also been dismissed and as such, the judgment passed by the Single Bench has attained finality. Learned counsel further submits that on the basis of said decision, respondents have issued a letter dated 07.11.2014 to grant the same benefits to all the similarly situated employees but the same has not been granted to the petitioner inspite of making a NEETU RANI 2015.07.08 09:54 I attest to the accuracy and authenticity of this document Chandigarh

CWP No.13181 of 2015 representation dated 02.03.2015 (Annexure P-9). Learned counsel also submits that the petitioner would be satisfied in case, directions are issued to respondents No.1 and 2 to consider the representation (Annexure P-9) moved by the petitioner in view of decision passed in Satyapal Yadav's case (supra).

In view of the submissions made by learned counsel for the petitioner, the present writ petition is disposed of with a direction to respondents No.1 and 2 to consider the representation (Annexure P9) filed by the petitioner in view of decision passed in Satyapal Yadav's case (supra) and in case, the petitioner is found entitled for the relief sought, the same be released to the petitioner within a period of three months from the date of receipt of certified copy of this order.

Disposed of accordingly.
