**** HARNARESH SINGH GILL, J.(Oral) Challenge is to the order dated 21.05.2022 (Annexure P-1) passed by the learned Judicial Magistrate, 1st Class, vide which cancellation report presented by the prosecution agency in FIR No.36 dated 20.02.2021, registered under Sections 420, 467, 468, 471 and 120B IPC, at Police Station Sadar, District Ludhiana, has been accepted. After arguing for some time, learned counsel for the petitioner prays for withdrawal of the present petition, with a liberty to avail appropriate remedy before the learned Sessions Court, challenging the acceptance of the cancellation report. He further submits that since the petitioner, under a bona fide impression, has approached this Court instead of Sessions Court, the delay which occurred because of the said reason, may be condoned.
